1. This matter is taken up through Hybrid Mode.
2. The Petitioner in this writ petition prays for the following relief: “It is therefore prayed that Your Lordships may graciously be pleased to admit the writ application, to issue notice to the Opp. Parties, to call for the LCR and after hearing to quash the order as at Annexure-1 and direct the Opp. Party No.2 – Bank participate in the proceeding pending U/s. 10 of I & B Code, 2016 before the NCLT at Cuttack for resolution of the disputes and payment of the loan outstanding dues in full and final settlement or to consider the representation to settle the matter by OTS Scheme in the interest of justice.”
3. In course of hearing, Mr. Baral, learned counsel for the Petitioner prays for withdrawal of the writ petition to seek remedy before the National Company Law Tribunal, Cuttack before whom a proceeding in respect of the secured asset is pending.
4. In view of such submission, this writ petition is disposed of as withdrawn.
