ORDER

31.08.2026

02.

1. Heard learned counsel for the Petitioners and learned counsel for the State.

2. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.896 of 2026 pending in the Court of learned S.D.J.M., Kendrapara, arising out of Patkura P.S. Case No.80 of 2026 for commission of offences punishable under Sections 115(2)/126(2)/ 296/3(5)/351(2) of the BNS.

3. Learned counsel for the State, on instruction, submits that the offence under section 109 of the BNS has been added by forwarding one of the co- accused.

4. Referring to the same, learned counsel for the Petitioners submits that though the ex facie the offences, as stated in the FIR, are bailable, the ABLAPL is maintainable.

5. Taking into account the nature of allegations and the nature of injury, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

6. Additionally, it is directed that the Petitioner No.1 shall appear before the jurisdictional police station once every week on such date and time to be fixed by the learned Court in seisin for a period of three months or till submission of final form, whichever is earlier. Certification of such appearance shall be submitted to the Court in seisin.

7. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.

8. Accordingly, the ABLAPL stands disposed of.
