04. (Through Hybrid Mode)
1. This matter is taken up from the weekly list.
2. This CMP has been filed challenging the order dated 09.12.2016 (Annexure-6) passed by the learned Addl. Senior Civil Judge, Puri in TS No.286 of 2001 rejecting the petition filed by the Petitioner to send the Ext.12 to handwriting expert.
3. While issuing notice on 11.01.2017, the further proceedings in the suit had been stayed by this Court.
4. None appears for the Opposite Parties when the matter is called.
5. Mr. D. Mishra, learned counsel for the Petitioner has filed a memo stating therein that the Petitioner does not want to press this application and hence, the matter may kindly be disposed of as withdrawn, which is taken on record.
6. Considering the fact that the CMP is pending since more than nine years, the suit must have been disposed of in the meanwhile.
7. Therefore, no useful purpose will be served by keeping this CMP pending, it is therefore dismissed.
8. Interim order passed earlier stands vacated. Misc. Case No. 07 of 2017 stands disposed of.
