ORDER

31.08.2026

01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.292 of 2026, pending on the file of learned JMFC, Gondia, arising out of Gondia P.S. Case No.217 of 2026 for commission of offences punishable under Sections 336(3), 318(4), 340(2) of BNS.

3. The prosecution case in essence is that the sale deeds which are on record have been obtained by playing fraud allegedly taking advantage of the fact that the Informant is an illiterate and pardanashin lady.

4. Learned counsel for the Petitioner submits that the sale deeds are of the year 2013 and 2016 and thereafter, mutation has been done and RoR has been published and till now no steps have been taken to get the same cancelled and in such background the Petitioner may be protected by pre-arrest bail.

5. Learned counsel for the State submits that granting pre-arrest bail would derail to the ongoing investigation.

6. Considering the rival submission and taking into account that the same is based on documentary evidence and that no steps have been taken for cancelation of deeds in question and subsequent steps taken as noted, it is directed that in the event of arrest of the Petitioner, she shall be released on bail by the Arresting Officer on such terms and conditions deemed just and proper with further conditions that she will cooperate with the investigation.

7. Violation of any of the above condition(s) shall entail cancellation of bail.

8. Accordingly, the ABLAPL stands disposed of.
