ORDER
29.08.2026
02.
1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with Special G.R. Case No.71 of 2025 pending on the file of learned Special Judge-cum- Sessions Judge, Nayagarh, arising out of Daspalla P.S. Case No.220 of 2023 for commission of offences punishable under Sections 376(2)(n) of BNS, 2023 read with Section 3(1)(w)(i)(ii), 3(2)(v) of SC/ ST (PoA) Act.
3. Taking into account the nature of allegations and the statement of the victim under Section 183 of BNSS, this Court was not inclined to entertain the earlier bail application of the Petitioner which was disposed of vide order dated 18.12.2025 in ABLAPL No.13717 of 2025.
4. The Petitioner did not avail the said order, inter alia, on the ground that while filing the charge sheet the Investigating Agency found him to be guilty for commission of offence under Section SC & ST (PoA) Act.
5. Considering the rival submissions prima facie this Court is persuaded to hold that the ABLAPL is not maintainable.
6. Accordingly, the ABLAPL stands disposed of.
7. Leave is granted to the Petitioner to avail the remedy in accordance with law.
