ORDER

29.08.2026 (Hybrid mode)

02.

1. Heard Mr. Sushree Sunil Kanta Nayak, learned Counsel appearing for the Petitioner, Mr. Mahendra Kumar Pradha, learned counsel appearing for the Opposite Party No.1 through virtual mode and Mr. Jayant Kumar Bal, learned Additional Government Advocate appearing for the Opposite

Party No.2.

2. Mr. Sushree Sunil Kanta Nayak, learned counsel appearing for the petitioner submitted that the Land Acquisition Officer/Authority was duly apprised of the pendency of the Civil Suit before the learned Civil Judge (Senior Division), Jajpur, concerning the internal dispute among the co-sharers in respect of Plot No. 530 under Khata No. 285/34, area Ac.0.16 decimals, Mouza: Kamardhi, P.S.: Mangalpur, Tahasil: Dasarathapur in the District of Jajpur, corresponding to Sabik Khata No. 11, Sabik Plot No. 339, Area Ac.0.83 decimals, which has been acquired by the National Highways Authority. In view of the pendency of the said suit, the petitioner has approached the said authority with a prayer to restrain itself from disbursing the compensation amount until the dispute is finally adjudicated.

3. At this stage, Mr. Mahendra Kumar Pradhan, learned Senior Panel Counsel appearing for the Union of India (Road Transport and Highways), opposite party No. 1, submitted that necessary steps have already been taken to ensure that the compensation amount is not disbursed in favour of any person until the pending Civil Suit is finally adjudicated and in this regard the competent authority has also been intimated.

4. In view of the aforesaid submission, this Court is of the considered view that keeping the matter pending would serve no useful purpose, particularly when the learned Senior Panel

Counsel appearing for Opposite Party No.1 has fairly submitted that the disbursement of the compensation amount has been withheld for the time being and shall not be made in favour of any person until the pending Civil Suit is finally adjudicated. Accordingly, the grievance of the petitioner being redressed by the authority, the writ petition stands disposed of as having been rendered infructuous.

5. Pending Interlocutory Application(s), if any, stand(s) disposed of.
