1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner .is seeking pre-arrest bail in connection with C.T. Sp. (POCSO) Case No.97 of 2026, arising out Jajpur Sadar P.S. Case No.223 of 2026 pending on the file of learned Additional District & Sessions Judge-cum-Special Court under POCSO Act, Jajpur for commission of offences punishable under Sections 126(2)/115(2)/74/76/351(2) of the BNS read with section 8 of POCSO Act.
3. Considering the rival submissions and the statement of the victim recorded under section 183 of the BNSS and the fact that the Petitioner has been shown as an accused in Jajpur Sadar P.S. Case No.262 dated 19.10.2023 registered under sections 363/294/506 of the IPC, which has been subsequently turned to under sections 363/294/506/342/354 of IPC read with section 8 of POCSO Act, this Court is not inclined to entertain this application for exceptional remedy of pre-arrest bail.
10. The ABLAPL is accordingly rejected.
