ORDER

29.08.2026

01.

1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.32 of 2020(V) pending on the file of learned Special Judge, Vigilance, Berhampur arising out of Berhampur Vigilance P.S. Case No.32 of 2020 for commission of offences punishable under Sections 13(2) r/w 13(1)(a) of the Prevention of Corruption Act, 1988 as amended by P.C (Amendment) Act, 2018 read with Sections 468/409 of IPC.

3. It is submitted by the learned counsel that taking into account the nature of allegations custodial interrogation of the Petitioner is not warranted. Hence, the Petitioner may be protected by pre-arrest bail.

4. Learned counsel for the vigilance department opposes the prayer for pre-arrest bail and submits that since the investigation is still going on, the Petitioner may not be protected by pre-arrest bail.

5. Considering the rival submissions, it is directed that in the event of arrest of the Petitioner in connection with the aforesaid case, he shall be released on bail by the Arresting Officer on such terms and conditions deemed just and proper with further conditions that he will cooperate with the investigation.

6. Violation of any of the above condition(s) shall entail cancellation of bail.

7. It is needless to state here that the Petitioner shall cooperate and shall appear as and when summoned by the Investigating Agency.

8. Leave is granted to the vigilance authority to seek variance of this order if the desired cooperation is not extended.

9. While seeking the cooperation of the Petitioner, this Court has no iota of doubt that the Investigating Agency shall be conscious of the fact that the Petitioner is a lady.

10. Accordingly, the ABLAPL stands disposed of.

11. Urgent certified copy of this order be granted as per rules.

12. Copy of this order be made over to the learned counsel for the Vigilance Department, Mr. Dash, learned Standing Counsel.
