1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.

2. Heard learned counsel appearing for the Parties.

3. Learned counsel appearing for the Petitioner contended that even though claim of the Petitioner to get the benefit of LTA family pension for the period from 18.08.2010 to 10.03.2019 was rejected vide the impugned communication issued under Annexure-4, dtd.06.05.2024, but Government in the Finance

// 2 //

Department in its letter dtd.09.05.2025 so enclosed to I.A. No.2843 of 2026 has decided to allow the benefit of LTA family pension in favour of the Petitioner for the period from 18.08.2010 to 10.03.2019.

4. It is accordingly contended that since Government has accepted the Petitioner’s claim, with quashing of the impugned order, the matter be remitted to Opposite Party No.2 to release the benefit.

5. Mr. S.K. Patra, learned counsel appearing for Opposite Party No.2 on the other hand produced copy of order dtd.21.08.2026 wherein LTA family pension for the period from 18.08.2010 to 10.03.2019 has been sanctioned and Treasury Officer / Special Treasury Officer, Dhenkanal has been directed to release the benefits in favour of the Petitioner. (Copy of the letter dtd.21.08.2026 so produced in Court be kept in record).

6. Having heard learned counsel appearing for the Parties and considering the submissions made, since during pendency of the Writ Petition basing on the letter dtd.09.05.2025 so issued by the Government in the Finance Department, the benefit has already been sanctioned vide order dtd.21.08.2026 and the concerned Treasury has been directed to release the benefit in favour of the Petitioner, this Court is of the view that challenge made to the impugned order has become infructuous.

7. Accordingly, this Court is inclined to dispose of the Writ Petition.

8. The Writ Petition stands disposed of accordingly.
