ORDER

28.08.2026 Order No.

17.

1. This matter is taken up through Hybrid mode.

2. Learned counsel for the Opposite Party-Contemnor produces a copy of Office Order No.24/2026 dated 25.08.2026 issued by the Additional Chief Engineer, Southern Investigation Circle, Berhampur.

3. On perusal of the said Office Order, it appears that, pursuant to the order dated 03.05.2025 passed in W.P.(C) No.17510 of 2022, the Opposite Party-Contemnor has been pleased to bring over the NMR employees working under the Superintending Engineer, Kalahandi Investigation Division, Bhawanipatna, to the Work- Charged Establishment notionally with effect from 30.09.2021. The name of the Petitioner is specifically mentioned in the said Office

Order.

4. Learned counsel appearing for the Petitioner, at the outset, contended that although the Petitioner has been brought over to the Work-Charged Establishment, it has been mentioned that the financial benefits shall be admissible only from the date of his actual joining in the Work-Charged Establishment, in the pay and post as mentioned against him as per ORSP, 2017, with dearness allowance and other allowances as sanctioned by the State Government. He further contended that, in the meantime, the Petitioner has retired from service.

5. On a careful consideration of the submissions made by the learned counsel for the Petitioner, it appears that the prayer made in the present contempt application does not fall within the scope of the writ application, which has already been disposed of. This Court, in exercise of contempt jurisdiction, cannot issue any further direction beyond the scope of the order sought to be complied with.

6. Accordingly, the Contempt proceeding is dropped, with liberty to the Petitioner to approach this Court by filing a fresh writ petition, if so advised.
