ORDER

Order No. 28.08.2026

03.

1. This matter is taken up through hybrid mode.

2. This CONTC has been filed alleging non-compliance of order dated 30th March, 2026 passed by this Bench in W.P.(C) No.3253 of 2026.

3. The writ application was disposed of vide order dated 30th March, 2026 with the following direction: “4. Taking into consideration the nature of grievance made by the petitioner in the present Writ Application and that the application under section 3-H (4) of the Act is still pending with the CALA, Talcher in the district of Angul, this Court directs him to refer the matter to the competent Principal Civil Court having jurisdiction forthwith. It is, however, made clear that this Court has not expressed any opinion on the merit of the objection made by the petitioner under Annexure-4.”

4. A show cause affidavit has been filed by the Opposite Party stating that the objection filed by the Petitioner before the Competent Authority for Land Acquisition (CALA) was disposed of on 6th January, 2026, i.e., prior to disposal of the writ petition.

5. Mr. Mishra, learned counsel for the Petitioner, however, submits that he had no knowledge of such disposal, as no communication has been made by the CALA with regard to objection filed by the Petitioner.

6. In view of the above, Mr. Mishra, learned counsel for the Petitioner prays for withdrawal of the contempt petition seeking liberty to file a fresh writ petition assailing the order of rejection of his objection by the CALA.

7. Mr. Mohanty, learned Counsel appearing for the Opposite Party does not have any objection to the same.

8. In view of the above, the CONTC is disposed of with an observation that the Petitioner, if so advised, may avail the remedy against the order rejecting his objection by the CALA.

Urgent certified copy of this order be granted on proper application.
