ORDER

28.08.2026 Order No.

05.

1. This matter is taken up through Hybrid mode.

2. None appears for the Appellant when the matter is called.

3. No notice has been issued in the appeal, as the appeal has been filed with a delay of 265 days. Initially, the appeal was filed by the claimant-Appellant on 14.09.2015. Thereafter, the matter was listed before a Bench of this Court on two occasions, i.e., on 04.12.2015 and 10.02.2016. Though there was a delay of 265 days in filing the appeal, no accompanying application seeking condonation of delay was filed.

4. Although, this Court granted time on two occasions for taking steps for limitation, however, no steps have been taken and, in the meantime, more than a decade time has elapsed. Thus, the limitation in filing the appeal, and in the absence of any specific application with a prayer for condonation of delay, continues till date. As such,

Page 2 of 2. the delay has expanded and it is more than a decade as on date.

5. In view of the aforesaid position, this Court is of the view that the Appellant has lost interest in this litigation.

6. Accordingly, the appeal stands dismissed due to non- prosecution.
