3. It is submitted by the learned counsel that the Petitioner has been falsely implicated in the case at hand. Hence, he may be protected by pre-arrest bail.

4. It is further submitted that the Petitioner is similarly circumstanced with the co-accused, namely,

Kailash Ghadei, who has since been released on bail by this Court by order dated 02.12.2025 in ABLAPL No.13507 of 2025 and so far as antecedents of the Petitioner is concerned, he is cited as an accused in Baidyanathpur P.S. 5. Learned counsel for the State opposes the prayer for pre-arrest bail.

6. Considering the nature of allegations and the order passed in respect of the co-accused, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of any other criminal antecedent than the one as noted above and the nature of the injury.

7. If it comes to the fore that the Petitioner has any other criminal antecedent than the one as noted above and the injured has suffered any grievous injury, this order shall not be given effect to.
