ORDER

27.8.2026 Order No.

01.

1. Heard Mr. A.P. Bose, learned counsel for the Petitioner and Mr. S.N. Nayak, learned ASC for State-Opposite Parties.

2. The petitioner is serving as Principal of District Institute of Education and Training (DIET), Puri and he has been transferred as Principal, DIET, Bhadrak by the impugned order of transfer dated 21st August, 2026 under Annexure-1.

3. It is submitted by Mr. Bose, learned counsel on behalf of the petitioner that such transfer of the petitioner is against Government Policy as per School and Mass Education Department Resolution dated 18th September, 2025, where the approval of the next higher authority is required for any such transfer made beyond 15th of June. It is also submitted that the petitioner has not completed 3 years as Principal of the DIET, Puri, and therefore, his transfer is also in violation of such policy decision of the government. Digitally Signed Signed by: MANAS KUMAR PANDA Reason: Authentication Location: OHC, Cuttack Date: 27-Aug-2026 18:30:47 Signature Not Verified

4. It is seen from the impugned order that the order of transfer has been issued by the Secretary to Government in School and Mass Education Department and the petitioner has been transferred along with other such Principals posted at different places. Since the government has issued the order of transfer, therefore the question of approval of next higher authority is not at all required. Further, as per the submission of the petitioner, he continued at DIET, Puri since 2022 in another post prior to his joining as Principal. As such, no merit is seen in the challenge of petitioner to question his order of transfer.

5. However, the authority, i.e. the Secretary to Government in School and Mass Education Department (O.P. No.1) may re-consider his transfer order, if permissible, and in accordance with law, preferably within a period of four weeks from the date of receipt of certified copy of this order along with a copy of the writ petition.

6. With aforesaid observation and direction, the writ petition is disposed of.

7. An urgent certified copy of this order shall be issued on proper application.
