ORDER

27.08.2026

01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.

2. Heard learned counsel appearing for the Parties.

3. Learned counsel appearing for the Petitioner contended that Petitioner on the face of the pendency of the criminal proceeding in Berhampur Vigilance P.S. Case No.15 of 2025 corresponding to Vig. G.R. Case No.12 of 2025, the disciplinary authority initiated the Departmental Proceeding vide Memorandum No.3582 dated 23.02.2026 under Annexure-4 series.

3.1. It is contended that Petitioner will be seriously prejudiced if the disciplinary proceeding is disposed of, prior to disposal of the criminal proceeding, which has been initiated on self-same charges. It is accordingly contended that pending disposal of the criminal proceeding, the disciplinary proceeding be stayed.

// 2 //

4. Learned Addl. Standing Counsel for the State on the other hand contended that there is no bar for continuance of both the proceedings, even though the charges are same.

5. Having heard learned counsel appearing for the Parties and considering the submissions made and the fact that both the proceedings have been initiated on self-same charges, this Court while disposing the Writ Petition, observes that the disciplinary proceeding initiated vide Memorandum No.3582 dated 23.02.2026 under Annexure-4 series may continue, but no final order will be passed, till disposal of the criminal proceeding vide Berhampur Vigilance P.S. Case No.15 of 2025 corresponding to Vig. G.R. Case No.12 of 2025. Learned Special Judge, Vigilance, Berhampur is directed to expedite the trial of Berhampur Vigilance P.S. Case No.15 of 2025 corresponding to Vig. G.R. Case No.12 of 2025.

6. With the aforesaid observations and directions, the Writ Petition stands disposed of.
