ORDER

27.08.2026 Order No.

04.

1. Heard Ms. S. Rout, learned counsel for the Petitioner and Mr. T.K. Dash, learned Additional Government Advocate for State- Opposite Parties.

2. As per the direction of this Court, the Petitioner was granted opportunity to prefer appeal within a period of thirty days and he was protected from eviction from the case land till such period or till filing of the appeal, whichever is earlier.

3. The challenge in the writ petition was direction for eviction in Form “Kha” in respect of Plot No.723 and the Petitioner was granted opportunity to file appeal against said eviction in Form “Kha” at Annexure-3 to the writ petition. However, it was explained at paragraph 14 of the writ petition that, the Petitioner’s shop is situating over Plot Nos.724 and 725 and it was apprehended on the part of the Petitioner that the authorities may proceed to demolish his shop rooms in the guise of initiating proceeding in respect of Plot No.723. Digitally Signed Signed by: BASANTA KUMAR BARIK Reason: Authentication Location: High Court of Orissa, Cuttack Date: 27-Aug-2026 17:01:12 Signature Not Verified

4. Undisputedly, the eviction was not carried in respect of Plot No.723, and it is alleged that the shop of the Petitioner situating over Plot No.724 has been demolished on 13.03.2026. This process of demolition gives rise the cause of action to file this contempt petition.

5. Upon hearing both the parties and taking note of the scope of order dated 27.02.2026, passed in W.P.(C) No.6540 of 2026, which appears to be in respect of the Plot No. 723 mentioned in Form “Kha” under Annexure-3, no such action amounting to contempt could be perceived for violation of order dated 27.02.2026. Nonetheless, Geo-tagged photographs are annexed at Annexure-B/2 showing existence of the shop room of the Petitioner.

6. Accordingly, the contempt proceeding is dropped and the CONTC is disposed of.
