ORDER

27.08.2026

02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.1062 of 2026 pending on the file of learned SDJM, Dhenkanal, arising out of Dhenkanal Sadar P.S. Case No.617 of 2026 for commission of offences punishable under Sections- 103(1)/3(5) BNS.

3. It is submitted by the learned counsel that merely because the Petitioner was the last person to travel with the deceased, she has been named as accused. Hence, she may be protected by pre-arrest bail.

4. Learned counsel for the State opposes the prayer for pre-arrest bail.

5. On perusal of the Case Diary including the statement of Akash Kumar Bhoi, the conduct of the Petitioner, the call made by the deceased and recitals of the Case diary referring to the CCTV footage that on getting down from Puri-Rourkela passenger train along with the Petitioner, the deceased went outside the station alone and the statement made at the bar that the Petitioner has joined the investigation, this Court persuaded to hold that the custodial interrogation of the Petitioner is not warranted.

Hence, it is directed that in the event of arrest of the Petitioner in connection with the aforesaid case, she shall be released on bail by the Arresting Officer on such terms and conditions deemed just and proper with further conditions that she will cooperate with the investigation.

6. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
