ORDER

27.08.2026

01. 1. Heard learned counsel for the Petitioners and learned counsel for the State.

2. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.1104 of 2026 pending on the file of learned S.D.J.M., Dhenkanal, arising out of Dhenkanal Town P.S. Case No.492 of 2026 for commission of offences punishable under Sections 127(2)/ 115(2)/ 351(2) /190/ 191(2)/ 191(3) /296 /303(2) /324(4) /333 /74 /76/ 75(2) of BNS, 2023.

3. It is submitted by the learned counsel for the Petitioners that the genesis of the offence is on account of commotion leading to parking of vehicles and the overt act is not attributed to the Petitioners. Hence, they may be protected by pre-arrest bail.

4. It is submitted by the learned counsel that the co-accused has since been released on pre-arrest bail by this Court by order dated 31.07.2026 in ABLAPL No.8656 of 2026 and since the Petitioners are at all fours with the said co-accused, on the ground of parity they seek pre-arrest bail.

5. Such submission is opposed by the learned counsel for the State inter alia on the ground that all the accused persons conjointly committed the offence. Hence, the segregation as prayed for by the learned counsel for the Petitioners is not to be entertained at this stage when the investigation has just commenced.

6. Taking into account the nature of allegation, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

7. Additionally it is directed that the Petitioners shall appear before the jurisdictional police station on such date and time to be fixed by the learned Court in seisin for the next three months or till submission of final form whichever is earlier. Certification of such appearance shall be submitted to the learned Court in seisin.

8. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.

9. Accordingly, the ABLAPL stands disposed of.
