ORDER

25.08.2026

01.

1. The writ petition, being W.P. (C) No.8376 of 2025 (PIL), wherefrom this contempt application arises, was disposed of on 07.05.2025 recording the submission made by the learned Addl. Standing Counsel that the effective steps have been taken against the encroachers of the gochar land, and, in fact Encroachment Case has also been initiated and final order may be passed on a particular date.

2. Taking into consideration the aforesaid facts so disclosed, the aforesaid writ petition involving public interest litigation was disposed of as we do not find any further direction to be passed in this regard.

3. This contempt application is taken out that despite the direction passed therein, the encroachment has not been removed. It appears from the tenet of the order that the matter comes within the purview of the technical contempt in fact no direction was passed in the said writ petition in the nature of public interest litigation upon the authority to do or not to do a thing. If the proceeding is disposed of after recording the submission, such submission could not be treated as a direction passed by this Court. The facts taken into account for disposal of the matter cannot be perceived as a substantive direction passed therein.

4. In view of the above, we do not find any alleged offence to have been committed by the alleged contemnor.

5. The contempt proceeding is dropped and the CONTC is accordingly disposed of.
