ORDER

25.08.2026 Order No.

01.

1. This matter is taken up through Hybrid mode.

2. Heard learned counsel for the Petitioner as well as the learned Additional Government Advocate. Perused the CRLMC application as well as the prayer made therein.

3. By filing the present application, the Petitioner has prayed for a direction to the learned J.M.F.C-IV, Cuttack, for early disposal of the petition filed by the Petitioner under Section 91 of the Cr.P.C. in G.R. Case No.1265 of 2024, arising out of Madhupatna P.S. Case No.320 of 2024.

4. Learned counsel for the Petitioner, at the outset, contended that although the application under Section 91 of the Cr.P.C. has been pending for a considerable period, the prosecution has not filed its reply thereto. As a result, there has been a delay in disposal of the said application. Hence, the Petitioner has filed the present

Page 2 of 2. application seeking early disposal of the same.

5. Learned counsel for the State, on the other hand, has no objection if a direction is issued to the learned trial court for early disposal of the said application.

6. Considering the submissions made by the learned counsel appearing for both sides and further taking note of the nature of the prayer made in the present application, this Court deems it proper to dispose of the application at the stage of admission by directing the learned trial court to dispose of the application of the Petitioner filed under Section 91 of the Cr.P.C by passing a speaking and reasoned order, as expeditiously as possible, preferably within a period of six weeks. It is open to the prosecution to file its objection, if any, within two weeks from the date of communication of a copy of today’s order.

7. With the aforesaid observations and directions, the CRLMC stands disposed of.
