3. The Petitioner has filed the present writ application with the following prayer:
“It is therefore, prayed that, this Hon'ble court may graciously be pleased to issue RULE NISI to the Opp. Parties, calling upon them to show cause as to why the writ petition filed by the petitioner shall not be allowed and if the opp. Parties fail to show cause or in sufficient cause the said Rule may be absolute directing the O.P. 4. Learned counsel for the Opposite Party No.4-Bank, at the outset, contended that on the basis of a notice received under Section 106 of B.N.S.S., 2023 from the office of the Assistant Sub-Inspector, Cyber Crime Police Station, Hisar, Haryana with a request to mark debit freeze on the account bearing Account No.368601000195 of the Petitioner, the Opposite Party No.4-Bank has freezed the operation of the bank account.
5. In reply to the same, learned counsel for the Petitioner contended that as per the allegation, the alleged fraudulent transactions make up only a sum of Rs.5,326/-. However, the Opposite Party-Bank has completely freezed the bank account, thereby making impossible to the Petitioner to operate his bank account.

Considering the submissions made by the learned counsels appearing for the respective parties, on a careful examination of the background facts as well as on a careful scrutiny of the letter dated 02.06.2026, further taking into consideration the fact that the alleged fraudulent transaction involves a sum of Rs.5,326/-, this Court deems it proper to dispose of the writ petition by directing the Opposite Party No.4-Bank to allow the Petitioner to operate his bank account keeping lien over a sum of Rs.5,326/- in the account of the Petitioner until further instruction received from the investigating agency. The Petitioner shall also furnish an undertaking before the bank authorities that he shall indemnify the Bank in the event the
Petitioner is found liable to pay any amount.
