ORDER

25.08.2026

02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with T.R. Case No.49 of 2023 pending on the file of learned 1st Add. Sessions Judge-cum- Special Judge, Khordha, arising out of Baghamari P.S. Case No.72 of 2023 for commission of offences punishable under Section 21(b)/29 of NDPS Act.

3. The allegation against the Petitioner is that he is involved in transportation of contraband (brown sugar) to the tune of 13.95 grams.

4. It is submitted by the learned counsel for the Petitioner that since the basis of implication is on account of co-accused statement and the Petitioner is stated to be physically handicapped, leniency may be shown.

5. Learned counsel for the State opposes the prayer for pre-arrest bail.

6. Taking into account the nature of allegation and filing of the charge sheet, this Court is not inclined to entertain the application for pre-arrest bail. However, in the event the Petitioner surrenders before the learned Court in seisin in the aforesaid case and moves an application for their release on bail, the same shall be considered on its own merit.

Ground of parity, if so urged, shall be taken into account.

7. Accordingly, the ABLAPL stands disposed of.
