ORDER

25.08.2026

02. 1. Heard learned counsel for the Petitioner, learned counsel for the State and the Informant in Person.

2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.59 of 2026 pending on the file of the learned Additional Sessions Judge- Cum-Special Judge under POCSO Act, Kendrapara arising out of Pattamundai P.S. Case No.298 of 2026 for commission of offences punishable under Section 296/351(2) of BNS read with Section 8/12 of POCSO Act.

3. It is submitted by the learned counsel for the State as per the recitals in the Case Diary that this is the second occasion when such an accusation is made against the Petitioner. On the earlier occasion the same was not reported to the Investigating Agency since the local gentry interfered.

4. The Informant who is present in person submits that the Informant and the victim are being threatened to withdraw the present case.

5. Such submission is opposed by the learned counsel for the Petitioner inter alia on the ground that there is no basis of such submission and the same is being made only to prejudice to this Court.

6. Considering the rival submission and on going through the statement of the victim recorded under Section 183 of BNSS and that she is a student of Class-VI, this Court is not inclined to entertain this application for pre-arrest bail. However, in the event the Petitioner surrenders before the learned Court in seisin in the aforesaid case and moves an application for his release on bail, the same shall be considered on its own merit without being influenced by any of the observations made herein.

7. Accordingly, the ABLAPL stands disposed of.
