ORDER
21.08.2026
02.
1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.278 of 2024 pending on the file of learned NGN-cum-JMFC, Odagaon arising out of Sarankul P.S. Case No.116 of 2024 for commission of offences punishable under Sections 363/ 366/ 34 of IPC.
3. It is submitted by the learned counsel that, in the meanwhile, investigation has been concluded and charge sheet has been filed under Sections 363, 366 and 34 of IPC and referring to the statement of the victim, the Petitioner seeks pre- arrest bail.
4. Learned counsel for the State opposes the prayer for pre-arrest bail.
5. Considering the rival submissions in the light of the statement of the victim recorded under section 164 of Cr.P.C., this Court is persuaded to hold that custodial interrogation of the Petitioner is not warranted. Hence, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.
6. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.
7. Accordingly, the ABLAPL stands disposed of.
