1. This CMP has been filed challenging the order dated 22.09.2016 passed by the learned 3rd Additional Civil Judge (Senior Division), Cuttack in C.S. III No. 814 of 2015, rejecting the application filed by the defendant under Order 7 Rule 11 read with Section 151 of the CPC.
2. On 24.11.2016, further proceedings in C.S. III No. 814 of 2015 had been stayed by this Court.
3. None appears for the Petitioner and the Opposite Party when the matter is called.
4. As per instructions obtained by the Registry over telephone from the Court of the learned 3rd Additional Civil Judge (Senior Division), Cuttack, C.S. III No. 814 of 2015 has been withdrawn on 12.11.2022 in the National Lok Adalat.
6. In view of the disposal of the Civil Suit, without going into the maintainability of the CMP, the CMP is dismissed as no useful purpose will be served by keeping it pending.
7. Interim order passed earlier stands vacated.
5. Misc. Case No. 1759 of 2016 stands disposed of.
6. Urgent certified copy of this order be granted on proper application.
