1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.566 of 2016 pending on the file of learned S.D.J.M, Bhanjanagar, Dist- Ganjam, arising out of Bhanjanagar P.S. Case No.289 of 2016 for commission of offences punishable under Sections 399 / 402 of IPC, 1860 r/w Sec. 4 & 5 of Explosive Substances Act, 1908.
3. Learned counsel for the State opposes the prayer for pre-arrest bail and submits that the Petitioner has the following criminal antecedents:-
“1. Gangapur PS case No. 129, Dated 26.05.2020 U/s.399/402 IPC/
B)(a)/27 Arms Act/4 & 5 E.S. Act.
2. Bhanjanagar PS case No. 318, dated 29.06.2022, U/s. 20(b)(ii)C of N.D.P.S, Act.
3. Bhanjanagar PS case No.343, dated 4.11.2016, U/s.399/402 IPC/4 & 5 E.S. Act.
4. Purusottampur PS case No. 10, dated 25,1.2018, U/s.399/402 IPC.
5. Bhanjanagar PS case No.43, dated 07.02.2019, U/s.294/427 IPC/4 & 5 E.S. Act.
6. Bhanjanagar PS case No.49, dated 15.02.2019, U/s.353/307/34 IPC/ 25 (1- B)(a)/27 Arms Act.
7. Bhanjanagar PS case No.83/2019 U/s.294/427/341 IPC/ 4 & 5 E.S. Act.
8. Bhanjanagar PS case No.154/2019, U/s, 3, 4& 5 E.S. Act.
9. Gangapur PS case No.5/2020 U/s.399/402 IPC/ 25 (1-B) (a)/27 Arms Act/4& 5 E.S. Act.
10. AskaP.S. Case No. 741 of 2021.”
4. Taking into account the nature of allegations and the criminal proclivities of the Petitioner as noted hereinabove, this Court is not inclined to entertain the application for pre-arrest bail. However, in the event the Petitioner surrenders before the learned Court in seisin in the aforesaid case and moves an application for his release on bail, the same shall be considered on its own merit.
Ground of parity, if any, may be considered by the learned court below.
5. The ABLAPL is accordingly disposed of.
