ORDER

21.08.2026

02.

1. By an order dated 22.12.2021, a direction was passed upon the authority to consider the representation dated 10.12.2019 (Annexure-5 series) and dispose of the same after affording an opportunity of hearing to the petitioner as well as opposite party Nos.2 to 5 not later than 11th April, 2022 and the same shall be communicated to the parties not later than 18th April, 2022.

2. The instant contempt application is taken out alleging that despite the said order having passed stipulating the time within which the authorities must ensure its strict compliance, no communication is made evidencing the disposal of the said representation. On the last occasion, a direction was passed for service of a copy of the contempt application on the alleged contemnor and pursuant to the service, the matter is listed today.

3. Mr. K.C. Kar, learned counsel appearing for the alleged contemnor submits that though there has been a considerable delay in implementing the order passed by this Court on 22.12.2021 in W.P.(C) No.26106 of 2019 but, in fact, the said representation has been disposed of and duly communicated to the petitioner vide Memo No.2078/G & M, dated 21.09.2024.

4. Learned counsel appearing for the petitioner showed his inability to apprise the Court in absence of any instruction from his client and pray before this Court that the copy of the said order may be served upon him for future action to be taken in this regard.

5. It appears from the documents produced before us that the abstract of the order is communicated to the Court but not the full text of the order passed by the ADM-cum-Addl. Registrar of Societies, Ganjam, Chatrapur. Though delay in compliance is also treated as a contemptuous act but we feel that once the authority has disposed of the said representation, it would not sub-serve the purpose to continue with the contempt application. The authorities are simply reminded of their solemn duty to adhere the time limit set forth in the order passed by this Court and any dormant and/or lethargic attitude shown thereto tantamounting to a contemptuous act, should be dealt with as per the provisions contained under the Contempt of Courts Act.

6. The abstract of the order is handed over to the learned counsel appearing for the petitioner. Learned counsel for the alleged contemnor is directed to serve the full text of the order passed by the said authority upon learned counsel for the petitioner within a week from today.

7. Since the order dated 22.12.2021 passed by this Court in W.P.(C) No.26106 of 2019 appears to have been complied with, the contempt proceeding is dropped.

8. The CONTC is, accordingly, disposed of.
