ORDER

21.08.2026

01. 1. Heard learned counsel for the Petitioners and learned counsel for the State.

2. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.631 of 2026 pending on the file of learned S.D.J.M., Phulbani, arising out of Phulbani Town P.S. Case No.201 of 2026 for commission of offences punishable under Sections 126(2), 115(2), 118(1), 304, 111(2)(b), 351(2), 3(5) of B.N.S. Act, 2023.

3. It is submitted by the learned counsel for the Petitioners that an altercation has been blown out of proportion and the Petitioners have been cited as accused and it is submitted that no one has suffered any major injury in the incident. Hence, the

Petitioners who have no criminal antecedent may be protected by pre-arrest bail.

4. Learned counsel for the State opposes the prayer for pre-arrest bail since the investigation is at a nascent stage.

5. Considering the nature of allegation, it is directed that on surrendering within four weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature and the nature of injury.

6. If it comes to the fore that the Petitioners have any such criminal antecedent and the injured has suffered any grievous injury, this order shall not be given effect to.

7. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.

8. Accordingly, the ABLAPL stands disposed of.
