02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.489 of 2024 pending on the file of learned Nyayadhikari, Gramanyayalaya- cum-J.M.F.C., Odagaon arising out of Odagaon P.S. Case No.299 of 2024 for commission of offences punishable under Sections 85/ 296/ 115(2)/ 351(2)/ 3(5)/ of the BNS, 2023 read with Section 4 of Dowry Prohibition Act, 1961 and read with Section 66/ 67(A) of the IT Act, 2000.
3. Learned counsel for the Petitioner, on instruction, submits that in the meanwhile the
Investigating Agency has taken recourse to the provisions as contained in Section 35(3) of BNSS.
4. In view of the same, since there is no perceptible threat of arrest, the ABLAPL accordingly stands disposed of.
5. Liberty is granted to the Petitioner to renew his prayer, if there is any fresh cause of action.
