ORDER

21.08.2026

02.

1. Heard learned counsel for the Petitioners and learned counsel for the State.

2. The Petitioners are seeking pre-arrest bail in connection with C. T. Case No.04 of 2025 pending on the file of learned J.M.F.C., Pattamundai, Dist- Kendrapara arising out of Pattamunai P.S. Case No.371 of 2024 for commission of offences punishable under Sections 109/ 115(2)/ 121/ 126(2)/ 132/ 296/ 324(4)/ 351(2)/ 74/ 3(5) of BNS, 2023.

3. It is submitted by the learned counsel that to cover up the overt act committed by the officials, the Petitioners have been falsely implicated in the case at hand and such excesses committed by the officials is clearly borne out from the complaint petition filed by the Petitioners and in such background, the Petitioners may be protected by pre-arrest bail.

4. Learned counsel for the State opposes the prayer for pre-arrest bail particularly referring to the offence as under Section 132 of BNSS and that some of the staffs have suffered injuries.

5. This Court perused the statement as well as the injury report which indicate that there was an abrasion.

6. Considering the same, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature.

If it comes to the fore that the Petitioners has any such criminal antecedent, this order shall not be given effect to.

7. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.

8. Accordingly, the ABLAPL stands disposed of.
