1. This CMP has been filed challenging the order dated 28.06.2016 passed by the learned Civil Judge (Senior Division), Kantabanji in C.S. No. 34/11 of 2003-13 (Annexure-4), rejecting the application filed by the Opposite Parties (third parties) under Order 1 Rule 10 of the CPC to implead them as parties.
2. Although notice had been issued on 15.11.2016, but no interim order had been passed by this Court.
3. Mr. S.K. Joshi, learned counsel for the Petitioners has filed a memo stating that the CMP has become infructuous as the suit has been disposed of. The memo is taken on record.

4. As the suit has been disposed of, nothing remains to be decided in this CMP, which is therefore dismissed.
5. Misc. Case No. 1788 of 2016 stands disposed of.
6. Urgent certified copy of the order be granted on proper application.
