1. This matter is taken up through hybrid mode.
2. Mr. Rath, learned counsel for the Petitioner submits that the matter was listed on 11th August, 2026, on which date learned counsel for the Petitioner submitted that the issue involved in this writ petition has already been resolved. Hence, the writ petition was disposed of as withdrawn.
2.1 However, inadvertently, on the very same day, another order was passed adjourning the matter on 13th August, 2026. On 13th August, 2026, this Court directed learned State Counsel to take instruction in the matter. 3. When the matter was listed on 13th August, 2026, it was not brought to the notice of this Court that the matter was disposed of as withdrawn on 11th August, 2026. Hence, this Court on 13th August, 2026 directed Mr. Mohanty, learned counsel for DMET to take instruction in the matter.
4. Mr. Rath, learned counsel for the Petitioner, however, submits that the order of withdrawal of the writ petition may be retained and separate order passed on 11th August, 2026 adjourning the matter to 13th August, 2026 and consequential order dated 13th August, 2026 may be recalled.
5. Hence, the orders dated 11th August, 2026, adjourning the matter to 13th August, 2026 and order dated 13th August, 2026 are recalled. Order dated 11th August, 2026, disposing of the writ petition as withdrawn shall stand to operate.
Urgent certified copy of this order be granted on proper application.
