07. 20.08.2026 (Through hybrid Mode)
1. This matter is taken up from the weekly list.
2. The CMP has been filed challenging the order dated 09.08.2016 passed by the learned Additional Senior Civil Judge, Berhampur in C.S. No. 53/2012 (Annexure-4), rejecting the application filed by the defendant no.2 under Order 6, Rule 17 of the CPC for amendment of her written statement.
3. While issuing notice on 01.11.2016, further proceeding in the suit had been stayed by this Court.
4. None appears for the Petitioner when the matter is called.
5. Mr. R.K. Mohapatra, learned counsel appearing on virtual mode for the Opposite Party No.1 submits that in the meanwhile, C.S. No. 53/2012 has been disposed of on 29.01.2024. The copy of the judgment is filed along with a memo which is taken on puspa record.
6. In view of the disposal of the civil suit, nothing remains to be decided in the CMP, which is accordingly dismissed.
7. Interim order passed earlier stands vacated.
8. Misc. Case No. 1604 of 2016 stands disposed of.
