3. Mr. Himansu Sekhar Deo, learned Advocate appearing for the petitioner submitted that the letter dated 20.12.2023 was issued by the

B) Division instructing the Additional Chief Engineer (Estt.)-cum-1st Appellate Authority in the Office of the EIC (Civil), Odisha, Bhubaneswar to intimate the petitioner to attend the Office of the Superintending Engineer and 1st Appellate Authority, Sonepur (R & B) Division in between 02.01.2024 to 04.01.2024 (11.00 A.M. to 1.00 P.M.). It is submitted that the said letter was received by the petitioner on 06.01.2024 by Post. Therefore, he could not attend the concerned Office in time.

3.1. The petitioner has not received any subsequent communication, if any, made in this regard. Hence, he prayed that the petitioner, for the aforesaid purpose, may be permitted to appear before the

B) Division on 19.09.2026 or 25.09.2026 or 26.09.2026. Hence, learned counsel for the petitioner prayed that necessary direction may be given to the authority concerned to appear before him on the relevant dates as stated above.

4. Mr. Suryakanta Parhi, learned Addl. Standing Counsel has no objection to the above submissions made by learned Advocate for the petitioner.

5. Since the petitioner was given opportunity to verify the cash book, pay particulars and original pay documents of her husband, who have already retired from service on 30.04.2023 as per the letter dated 20.12.2023 of the Superintending Engineer and 1st Appellate Authority, Sonepur (R & B) Division, but due to reason stated above, she could not comply with the same, this Court on consent of the learned Additional Standing Counsel directs the petitioner to appear in the office of Office of the Superintending Engineer, Sonepur (R&B) Division, Sonepur for compliance of letter dated 20.12.2023 issued by the Superintending Engineer and 1st Appellate Authority, Sonepur (R&B) Division on 19.09.2026 or 25.09.2026 or 26.09.2026.

6. In view of the above conceded position, since there remains nothing to be decided in the instant writ petition, this Court feels it appropriate not to keep the instant writ petition pending as it would not subserve fruitful purpose.

7. Accordingly, the writ petition stands disposed of.
