ORDER

20.08.2026

01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with Special Case No.83 of 2026 pending on the file of learned Addl. District & Sessions-cum- Special Judge, (POCSO) Bhadrak, arising out of Bhandaripokhari P.S. Case No.256 of 2026 for commission of offences punishable under Section 294(2) / 296 / 351(3) and (5) of BNS, 2023 along with U/s.67 and 67(A) of I.T. Act of 2000 and also with U/s. 12 of POCSO Act of 2019.

3. Learned counsel for the State opposes such prayer.

4. Taking into account the recitals of the F.I.R which prima facie made out a case under Section 67 of I.T. Act, this Court is not inclined to entertain the application for pre-arrest bail. However, in the event the Petitioner surrenders before the learned Court in seisin and moves an application for his release on bail, the same shall be considered on its own merit.

5. It is needless to state that this Court has not expressed any view regarding the complicity of the Petitioner, which has to be established in an independent manner in the ongoing investigation and in the ongoing trial.

6. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
