ORDER
20.08.2026
02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.385(A) of 2025 pending on the file of learned J.M.F.C. (P), Kujanga, arising out of Kujanga P.S. Case No.165 of 2025 for commission of offences punishable under Sections 103(1)/3(5) of the BNS.
3. Counsel for the Petitioner submits that taking into account the nature of circumstantial evidence, which is the basis of implication, the Petitioner may be protected by pre-arrest bail.
4. Such submission is opposed by the learned counsel for the State.
5. This Court perused the materials on record including the charge sheet where the Petitioner is cited as an accused. Considering the same, this Court is not inclined to entertain this application of pre-arrest bail. However, it shall be open for the Petitioner to surrender and move for bail before the Court in seisin, which shall be considered on its own merit, without being prejudiced by the order passed by this Court. The ground of parity, if urged, shall be taken into account.
6. The ABLAPL is accordingly disposed of.
Issue urgent certified copy as per rules.
