ORDER
20.08.2026
01.
1. Heard learned counsel for the Petitioners and learned counsel for the State.
2. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.680 of 2026 pending on the file of learned S.D.J.M, Athagarh arising out of Gurudijhatia P.S. Case No.185 of 2026 for commission of offences punishable under Sections 126(2)/ 296/ 115(2)/109(1)/351(2)/351(3)/3(5) of BNS, 2023.
3. It is submitted by the learned counsel that since co-accused persons have been enlarged on bail vide order dated 18.08.2026 in ABLAPL No.9487 of 2026, on the ground of parity, the Petitioners may be protected by pre-arrest bail.
4. Learned counsel for the State opposes the prayer for pre-arrest bail and submits that what weighed with Court in releasing the co-accused is that they are ladies.
5. Considering the rival submissions, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature and the nature of the injury.
If it comes to the fore that the Petitioners have any such antecedents and the injured has suffered any grievous injury, this order shall not be given effect to.
6. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.
7. Accordingly, the ABLAPL stands disposed of.
