ORDER
20.08.2026
01.
1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.1864 of 2025 pending on the file of learned JMFC (R), Cuttack arising out of Jagatpur P.S. Case No.729 of 2025 for commission of offences punishable under Sections 109(1), 296, 351(2) and 3 (5) of BNS, 2023 r/w Sections 3 & 4 of the Explosive Substances Act, 1908.
3. The allegation against the present Petitioner in essence is of storing explosive substances.
4. It is submitted by the learned counsel that though it has been referred to as explosive substances, but, in fact, they are fire crackers and the persons similarly circumstanced have been enlarged on bail by this Court, the orders are on record. Hence, on the ground of parity, the Petitioner seeks pre-arrest bail.
5. Learned counsel for the State opposes the prayer for pre-arrest bail.
6. Taking into account the nature of allegations and since on one has injured, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of not more than one criminal antecedent of any nature.
If it comes to the fore that the Petitioner has more than one criminal antecedent of any nature, this order shall not be given effect to.
7. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.
8. Accordingly, the ABLAPL stands disposed of.
