ORDER

20.08.2026

01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.214 of 2017 pending on the file of learned J.M.F.C., Chandbali arising out of Chandbali P.S. Case No.66 of 2017 for commission of offences punishable under Section

A/304B/306/34 of IPC read with Section 4 of DP Act.

3. It is submitted by the learned counsel that the Petitioner is the mother-in-law and taking into account her complicity in charge sheet, this Court directed her release on surrendering by order dated 16.02.2022 in ABLAPL No.1667 of 2020.

4. It is submitted by the learned counsel that because of overwhelming circumstances, the Petitioner could not avail the said order and because of the lapse of time, the Petitioner is apprehending that she shall be taken to custody.

5. Learned counsel for the State on the other hand submits that such apprehension is misconceived.

6. Taking into account that the Petitioner is a lady and aged about 60 years and the earlier order adverted to hereinabove, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

7. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.

8. Accordingly, the ABLAPL stands disposed of.
