ORDER

20.08.2026

01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.887 of 2026 pending on the file of learned S.D.J.M., Khurda arising out of Industrial Estate Khurda P.S. Case No.200 of 2026 for commission of offences punishable under Section 303(2)/305(e)/3(5) of BNS read with Section 51 of OMMC Rules, 2016.

3. It is submitted by the learned counsel that the Petitioner was before this Court in ABLAPL No.8732 of 2026 and this Court by order dated 03.08.2026 directed him that on surrendering he shall be released on bail.

4. It is submitted that inadvertently it could not brought to the notice of this Court that the Petitioner has one criminal antecedent which run thus:- “Khurda I.E. P.S Case No- 89 of 2025 U/s. 305(e)/3(5) and Sec- 51 of OMMC Rule.”

It is stated that the Petitioner is on bail in the said case.

5. It is the contention of the learned counsel that merely because the Petitioner has criminal antecedent that ought not to deter this Court from considering the prayer for pre-arrest bail.

6. Learned counsel for the State submits that the Petitioner did not approach this Court with clean hands. Hence, no leniency ought to be shown.

7. Considering the rival submission and that the Petitioner is not a named accused in the case at hand, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

8. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.

9. Accordingly, the ABLAPL stands disposed of.
