01. 1. Heard learned counsel for the Petitioners and learned counsel for the State.
2. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.1138 of 2026 pending on the file of learned JMFC-IV, Cuttack arising out of Bentkar(42 Mouza) P.S. Case No.264 of 2026 for commission of offences punishable under Sections 296, 115(2), 324(4), 304(2) and 3(5) of BNS, 2023.
3. Learned counsel for the State opposes the prayer for pre-arrest bail.
4. Taking into account that the principal offence is under Section 304(2) of BNS and the punishment prescribed, this Court has no iota of doubt that the investigating agency shall scrupulously follow the guidelines laid down by the Apex Court in the case of Arnesh Kumar vrs. State of Bihar & another, (2014) 8 SCC 273 and reiterated in the case of Satender Kumar Antil vrs. Central Bureau of Investigation & another, (2022) 10 SCC 51.
5. The ABLAPL is accordingly disposed of.
