ORDER
Order No. 19.08.2026
01.
1. This matter is taken up through hybrid mode.
2. Petitioner in this writ petition prays for a direction for early disposal of I.A. No.1143 of 2026 and I.A. No.1273 of 2026 (Annexure-6 series) arising out of S.A. No.202 of 2025 filed under Section of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for brevity ‘the SARFAESI Act’).
3. Mr. Achary, learned counsel for the Petitioner submits that the Petitioner has filed an application under Section 17 of the SARFAESI Act, which is pending for consideration. During pendency of the S.A., the Opposite Party-Bank proceeded with auction sale of the secured asset. Digitally Signed Signed by: SASHIKANT PARIDA Reason: Authentication Location: OHC Date: 19-Aug-2026 17:35:02 Signature Not Verified
4. In view of the above, two interim applications being I.A. No.1143 of 2026 and I.A. No.1273 of 2026 have been filed for interim protection, which are pending before the Debts Recovery Tribunal (for brevity ‘DRT’). Though the said applications were filed on 7th July, 2026 and 29th July, 2026 respectively, those are pending for consideration as the Opposite Party No.1-Bank is taking repeated adjournments. It is his submission that unless those interim applications are disposed of early, the Petitioner will be very highly prejudiced.
5. Mr. Udgatta, learned counsel appearing for the Opposite Party-UCO Bank submits that the Bank shall cooperate for early disposal of the aforesaid interim applications, if those are moved. It is also submitted that objection(s) to the aforesaid I.As., if not already filed, shall be filed by tomorrow, i.e., 20th August, 2026.
6. In view of the above, this Court, without expressing any opinion on the merits of the interim applications filed by the Petitioner, disposes of the writ petition with a direction that the DRT shall proceed to dispose of the I.A. No.1143 of 2026 and I.A. No.1273 of 2026 within a period of ten days from the date of production of the certified copy of this order.
6.1 It is also made clear that objection to the I.As., if not filed, shall be filed by 21st August, 2026 positively serving
copy thereof on Mr. Achary, learned counsel for the Petitioner.
Urgent certified copy of this order be granted on proper application.
