ORDER

19.08.2026

01.

1. The instant appeal arises from an interim order dated 12th June, 2026 passed by the single Bench in W.P.(C) No.17888 of 2026 wherein the Court refused to pass any interim order with regard to the reduction of the pension to the extent of 50% but restrained the authorities from taking any steps for recovery of the amount in terms of the order dated 11th May, 2026 till the next date.

2. The aforesaid writ petition was at the behest of the appellant challenging the order of punishment dated 11th May, 2026 wherein respondent No.1 directed to recover an amount of Rs.103.453 lakhs from the appellant and also to stop 50% pension of the appellant permanently. The matter is still at the nebulous stage of final determination. Once the order of such nature is assailed in the writ petition, the Bench in seisin of the said matter shall decide the same on its merit and the law applicable in this regard.

3. Since the interim order is already passed restraining the authorities from attempting to recover any amount allegedly paid in excess to the entitlement of the appellant is concerned, we do not think that the appellate Court should interfere at this stage. The Court has also taken into consideration that the appellant is being paid 50% of the pension in terms of the said order which does not need any interference. In the event the entire pension is granted to the appellant, it will virtually render the adjudication to be made in the writ petition and, therefore, we do not find any infirmity in the impugned order.

4. The appeal is, thus, dismissed. No order as to costs.
