ORDER

19.08.2026

03. 1. Since both the ABLAPLs relate to the same FIR, on the consent of the parties, they are taken up together for consideration and disposed of by this common order.

2. Heard learned counsel for the Petitioners and learned counsel for the State as well as the Informant.

3. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.557 of 2026 pending on the file of learned SDJM, Khurdha arising out of Jankia P.S. Case No.278 of 2026 for commission of offences punishable under Sections 296/ 118(2)/ 115(2)/ 351(2)/ 3(5) of B.N.S.

4. It is submitted by the learned counsel for the Petitioners that because of ongoing civil litigation, exaggerated allegations have been made more particularly relating to offence under Section 109 of BNS. Hence, they may be protected by pre-arrest bail.

5. Such submission is opposed by the learned counsel for the State referring to the statement of the injured- Suchismita and submitting that she has suffered grievous injury.

6. This Court perused the statement of said Suchismita, which in essence indicate that the overt act is attributed to the Petitioner No.1 in ABLAPL No.5405 of 2026.

7. Considering the rival submission, this Court is not inclined to entertain the application for pre-arrest bail in respect of Petitioner No.1 in ABLAPL No.5405 of 2026. However, in the event the Petitioner No.1 in ABLAPL No.5405 of 2026 surrenders before the learned Court in seisin and moves an application for his release on bail, the same shall be considered on its own merit.

8. So far as the Petitioner in ABLAPL No.7721 of 2026 and Petitioner Nos.2 and 3 in ABLAPL No.5405 of 2026 are concerned, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner in ABLAPL No.7721 of 2026 and Petitioner Nos.2 and 3 in ABLAPL No.5405 of 2026 shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

9. It is further stated that the Petitioner in ABLAPL No.7721 of 2026 and Petitioner Nos.2 and 3

in ABLAPL No.5405 of 2026 shall cooperate with the ongoing investigation.

10. Accordingly, the ABLAPL stands disposed of. U.C.C. as per rules.
