ORDER

19.08.2026 Order No. 01

1. This matter is taken up through hybrid mode.

2. Heard Mr. S.S. Nayak, learned counsel appearing on behalf of Mr. R. Roy, learned counsel for the Petitioner and Mr. S.P. Das, learned Addl. Standing Counsel appearing for the Opp. Parties.

3. The present writ petition has been filed inter alia with the following prayer:- “In view of the above stated facts and circumstances, it is therefore humbly prayed that this Hon'ble Court may graciously be pleased to issue Rule NISI calling upon the Opposite Parties, more particularly the Opp. Party No.3 to show cause as to why the proceeding/recommendation of the Screening Committee dated 11.09.2019, so far as it relates to the Petitioner, shall not be approved and implemented forthwith, and further as to why the pay of the Petitioner shall not be fixed under the Odisha Revised Scales of Pay Rules, 2017 with effect from

01.01.2016 with all consequential service and pensionary benefits, If the Opp. Parties fail to show cause or show insufficient cause, this Hon'ble Court may make the said Rule absolute by directing the Opposite Parties, more particularly the Opp. Party No.3 to implement the proceeding/recommendation of the Screening Committee dated 11.09.2019, so far as it relates to the Petitioner, and further be pleased to direct the Opp. Parties to fix the pay of the Petitioner under the Odisha Revised Scales of Pay Rules, 2017 with effect from 01.01.2016 with all consequential service and pensionary benefits, And for this act of kindness, the Petitioner as in duty bound shall ever pray.

4. It is contended that the decision taken by the RMC, Hinjilikatu in its proceeding dtd.11.09.2019 under Annexure-4 though has been sent for approval to Opp. Party No. 3, but till date no decision has been taken by Opp. Party No. 3 either in approving the decision or in rejecting the same. It is accordingly contended that Opp. Party No. 3 be directed to take a decision on the decision taken by the Screening Committee in its proceeding dtd.11.09.2019 under Annexure-4.

5. Considering the nature of order going to be passed, this Court is of the view that no notice need be issued to the Opp. Parties.

6. Having heard learned counsel appearing for the Petitioner, this Court while disposing the writ petition, permits the Petitioner to move Opp. Party No. 3 for approval of the decision taken by the Screening Committee in its proceeding dtd.11.09.2019 under Annexure-4.

6.1. It is observed that, if any such application is moved before Opp. Party No. 3 within a period of three (3) weeks hence, the said Opp. Party shall do well to take a lawful decision on the same within a further period of three (3) months from the date of receipt of such application with due communication to the Petitioner.

7. The writ petition accordingly stands disposed of.
