ORDER

Order No. 19.08.2026

01.

1. This matter is taken up through hybrid mode.

2. The writ petition has been filed for a direction to the Presiding Officer Debts Recovery Tribunal, Kataka (for brevity ‘the Tribunal’) to dispose of the S.A. No.169 of 2024 (Annexure-1) within a stipulated time.

3. Mr. Rout, learned counsel for the Petitioner-Bank submits that the S.A. filed under Section 17 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for brevity ‘the SARFAESI Act’) is ready in all respect and it is being posted for hearing on different dates. But the Tribunal is not taking up hearing of the S.A. and disposing of the same in spite of the mandate of the statute to dispose of the said application within an outer limit of four months. It is further submitted that there is no legal impediment for early disposal of the S.A. Digitally Signed Signed by: SASHIKANT PARIDA Reason: Authentication Location: OHC Date: 19-Aug-2026 17:35:02 Signature Not Verified

No.169 of 2024. In view of the above, the writ petition is filed seeking for the aforesaid relief.

5. Taking into consideration the submission made by Mr. Rout, learned counsel for the Petitioner and on perusal of the record, it is apparent that the S.A. filed under Section 17 of the SARFAESI Act is being posted to different dates for hearing but the hearing of the S.A. appears to have not been completed.

6. In view of the above, this Court disposes of the writ petition with a direction that in the event the Petitioner files an application for early disposal of the S.A. No.169 of 2024 stating the grounds therein and bringing notice of the Tribunal to the provision under Section 17 (5) of the SARFAESI Act, the Tribunal shall do well to consider such application as expeditiously as possible, preferably within a period of two weeks therefrom giving opportunity of hearing to the parties concerned and proceed with the S.A. accordingly.

Urgent certified copy of the order be granted on proper application.
