ORDER

19.08.2026

08. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.

2. Heard learned counsel for the parties.

3. The present Writ Petition has been filed inter alia with the following prayer:-

“Under the above circumstances it is prayed that this Hon'ble Court be pleased to issue a writ in the nature of mandamus or any other appropriate writ/writs directing the Opp. party not to struck down the name of the petitioner from the empanelled list for diploma holders prepared by the Opp. party for appointment of Junior Engineer in the different cadre department even after the petitioner forgo the contractual appointment as Grama Panchayat Technical Asst. (GPTA) in the Panchayat Raj Department under. Annexure-3 since the said post and salary is not equivalent to the Junior Engineer to the State Government.

// 2 //

And further be pleased to pass any other writ/writs and order/orders as this Hon'ble court may deem fit just and proper.”

4. It is contended that the Writ Petition was filed when petitioner apprehends that his name will be struck down from the empanelled list of Diploma Holders prepared by the Opp. Parties for his appointment as against the post of Junior Engineer, pursuant to the letter issued by the Govt. in the Panchayatiraj Department under Annxure-1.

5. Learned Addl. Standing Counsel on the other hand contended that since the petitioner has filed the Writ Petition basing on mere apprehension, the Writ Petition is not maintainable.

6. Considering the submission and the relief claimed, this Court is of the view that the Writ Petition has been filed on a mere apprehension that petitioner’s name will be struck down from the empanelled list of Diploma Holders.

6.1. In view of the nature of relief claimed, this Court is of the view that the Writ Petition is not entertainable. It is open for the petitioner to move the appropriate authority for consideration of his grievance, if any.

7. With the aforesaid liberty, the Writ Petition stands disposed of. (Biraja Prasanna Satapathy)
