1. This matter is taken up from the weekly list.
2. This CMP has been filed challenging the order dated 19.08.2016 passed by the learned Civil Judge (Senior Division), Bhubaneswar in Civil Suit No. 922 of 2011 (Annexure-4), rejecting the application filed by the defendant No.1 under Order 11 Rule 1 of the CPC to grant leave to put interrogatories to the plaintiff to answer.
3. While issuing notice on 07.09.2016, further proceeding in the suit had been stayed by this Court.
4. Mr. Amlan Mishra, learned counsel appearing on behalf of Mr. A.C. Panda, learned counsel for the Petitioner submits that he does not have any instructions if the suit is still pending.
5. Mr. P. K. Swain, learned counsel appearing on behalf of Opposite Party No.2 submits that the suit has been disposed of on 24.01.2026.
6. In view of the above submission, no useful purpose will be served by keeping this CMP pending, which is accordingly disposed of.
7. Interim order passed earlier stands vacated.
8. Misc. Case No. 1372 of 2016 stands disposed of.
9. Urgent certified copy of this order be granted on proper application.
