ORDER

19.08.2026

02. 1. Heard learned counsel for the Petitioners and learned counsel for the State.

2. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.316 of 2026 pending on the file of learned J.M.F.C., M. Rampur, arising out of M. Rampur P.S. Case No.168 of 2026 for commission of offences punishable under Section 115(2)/ 118(1)/ 109(1)/ 351(3) of BNS, 2023.

3. It is submitted by the learned counsel that in the case at hand the overt act is attributed to one Biswanath Sahu, who has since been taken into custody.

4. It is further submitted by the learned counsel, on instruction, that the injury suffered is simple in nature and the Petitioners have no criminal proclivity. Hence, the Petitioner may be protected by pre-arrest bail.

5. Learned counsel for the State opposes the prayer for pre-arrest bail.

6. Considering the rival submissions, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature and the nature of the injury.

If it comes to the fore that the Petitioners have any such criminal antecedents and the injured has suffered any grievous injury, this order shall not be given effect to.

7. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.

8. Accordingly, the ABLAPL stands disposed of.
