01.

1. Since both the ABLAPLs relate to the same FIR, on the consent of the parties, they are taken up together and are disposed of by this common order.

2. Heard learned counsel for the Petitioners and learned counsel for the State as well as learned counsel for the informant.

3. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.590 of 2026 pending on the file of learned Gramya Nyalaya-cum-J.M.F.C, Tangi, arising out of Nirakarpur P.S. 4. Learned counsel for the State as well as informant in ABLAPL No.8727 of 2026 oppose the prayer for pre-arrest bail notwithstanding that the injuries are simple in nature and submits that Petitioner No.1 (Bhola Srichandan @ Bholanath Srichandan) in ABLAPL No.8727 of 2026 has the following criminal antecedents:-

“1) Case No 43, Dt.28.04.2019, U/S 341/323/354/294/506/34 IPC

5. Learned counsel for the informant, on instruction, submits that the Petitioner No.2 (Trinath Srichandan) in ABLAPL No.8727 of 2026 has four antecedents.

6. So far as the ABLAPL in respect of Petitioner Nos.1 & 2 (Rajani Srichandan and Sarat Srichandan respectively) in ABLAPL No.8148 of 2026 is concerned it is stated that they also have criminal proclivities.

7. Considering the rival submissions, this Court is not inclined to entertain the application for pre-arrest bail in respect of Petitioner Nos.1 & 2 (Bhola Srichandan @ Bholanath Srichandan and Tinath Srichandan respectively) in ABLAPL No.8727 of 2026 and Petitioner Nos.1 & 2 (Rajani Srichandan and Sarat Srichandan respectively) in ABLAPL No.8148 of 2026. However, in the event the said Petitioners surrender before the learned Court in seisin in the aforesaid case and move an application for their release on bail, the same shall be considered on its own merit.

8. Nos.3 to 6 in ABLAPL No.8727 of 2026 is concerned, taking into account the nature of allegations and the punishment prescribed, this Court directs that on surrendering within three weeks hence and moving for bail, the said Petitioners (Kalpana Srichandan, Rashmita Srichandan @ Rasmita, Manita Srichandan and Liku Srichandan respectively) shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.
